TERMS & CONDITIONS

These conditions contain important terms which govern your business relationship with FIGHTLABEL Group Limited. Therefore please read them carefully and keep the supplied copy available for reference.

1 Definitions

1.1 In these Conditions:

“FIGHTLABEL” means FIGHTLABEL Group Limited:

“The Customer” means any person, undertaking, buying or offering to buy Goods from FIGHTLABEL:

“Goods” means all products supplied by FIGHT LABEL:

2 Terms

2.1 Orders are taken on receipt of a telephone call, internet, email, text message, mobile application (e.g. "WhatsApp") or by personal callers to our showroom.

2.2 Ownership of the goods remains with FIGHTLABEL until full payment is received from the customer for those said goods.

2.3 Should Credit terms be granted by FIGHTLABEL to the customer, payment will be made by the customer within 30 days of the invoice date, by Cheque, Cash, Credit Card, BACS or Bank Transfer. Payments will be made without any deductions, offset or counter claim without the prior consent of FIGHT LABEL.

2.4 Late payment will bear interest of 5% per month upon the sum that is not paid after the 30 day credit period.

2.5 Where FIGHTLABEL have to elect a third party to recover monies due, FIGHTLABEL shall be entitled to recover any cost thereof in full, from the customer.

2.6 Notwithstanding any instructions from the customer to the contrary, FIGHTLABEL may apply any monies it receives from the customer in discharge of the earliest dated invoices in respect of which payment has not been made.

2.7 Credit Card Payments will not be accepted on customers wishing to facilitate the 30 days credit terms. Otherwise a 3% charge will be made for this service, unless already agreed in writing by a Director of FIGHTLABEL.

3 Orders & Specifications

3.1 Any design specifically produced by FIGHTLABEL and any specifications supplied by the customer, in connection to the purchase of goods together with the copyright, design right or any other intellectual property rights, shall be the exclusive rights of FIGHTLABEL.

3.2 FIGHTLABEL shall not be liable in respect to any alleged defect in the goods as a result of any specifications made by the customer against the advice of FIGHTLABEL.

3.3 FIGHTLABEL may from time to time have to adjust its product specification without prior notification.

3.4 Once FIGHT LABEL have received a customers order, this will be prepared. Once preparation has been commenced the order cannot be cancelled in any way.

3.5 Due to colour sensitivity in fabrics FIGHTLABEL cannot guarantee Colour Fastness in any product.

3.6 If you order Custom products from FIGHTLABEL, then you accept FIGHTLABEL has no liability for errors or defaults which are caused by erroneous specifications supplied by you or the authorised representative. So FIGHTLABEL shall not be liable in respect of any problems arising as a result of incorrect measurements being provided (like a wrongly completed Measurement Chart).

3.7 Any sponsor logos supplied by the customer must be supplied in original editable artwork formats (PDF, EPS, AI) and FIGHTLABEL reserve the right to not apply any logos supplied incorrectly.

3.8 If sponsor logo sizes are not specified at the time of ordering, FIGHTLABEL will apply them in a size to scale which is proportionate with the design and any other logos on the item.

3.9 Sponsor logo colours cannot be guaranteed Pantone colour matches. Heat transfer vinyls are used and supplied in a range of standard colours, the closest colour match will be chosen unless a specific colour is requested by the customer at the time of ordering.

4 Fabrics

4.1 FIGHTLABEL source a range of fabrics including leathers, metallics, furs which are all suitable to make their custom designs, due to the nature of these fabrics there may be slight natural imperfections which are unavoidable and to be expected and accepted by the customer.

4.2 If the customer chooses a fabric which is not an advisable choice by FIGHTLABEL, then the outcome of the custom product is the responsibility of the customer.

4.3 If a fabric is sourced specifically for the customer and is ordered in, the customer is liable for the costs of that fabric should they wish to change their mind and use an alternative fabric.

4.4 If a fabric is unavailable, FIGHTLABEL reserves the right to use the nearest available fabric to meet the customer's order on time.

4.5 FIGHTLABEL are not responsible for any allergies/reactions to any fabrics used and chosen by the customer.

4.6 Certain fabrics require specific care instructions for storing/washing. For example leather cannot be washed. If the customer cares for the product incorrectly it is not the responsibility of FIGHTLABEL.

4.7 Sponsor logos are applied generally by heat transfer. Some fabrics cannot be heat transferred so logos must be embroidered. If these fabrics are chosen by the customer they are accepting of additional costs to embroider any logos required.

4.8 Once the customer is in possession of their goods, anything they do to them is their responsibility. For example if the customer adds additional logos and they are applied incorrectly, it is not FIGHTLABEL's responsibility to correct/amend/repair the goods.

4.9 FIGHTLABEL can supply specific washing instructions for the particular product ordered at the customer's request.

5 Deliveries

5.1 FIGHTLABEL may without prejudice suspend or cancel delivery of goods if the customer is in breach of its contractual obligations with regard to the credit terms. FIGHTLABEL at its sole discretion for any reason whatsoever so determined may terminate the credit terms to the customer.

5.2 FIGHTLABEL will as far as possible attempt to meet orders received and accepted. All orders are accepted conditionally upon the availability of the goods ordered, and FIGHTLABEL shall not be liable for failure to meet any order or part thereof for any reason whatsoever.

5.3 Any dates quoted for delivery are approximate and FIGHTLABEL shall not be liable for any delays in delivery howsoever caused.

5.4 The Risk in Goods will pass on Delivery. Carriers require that all claims be notified in writing within 7 days of the receipt of goods and non deliveries be notified within 14 days of the date of dispatch, for overseas deliveries 21 days. Claims notified after these periods will not be recognised.

5.5 Where so determined FIGHTLABEL shall use an insured/trackable “signed for” means of delivery. If the customer wishes an alternative non-trackable service the customer will be solely responsible for any loss.

5.6 International deliveries are shipped using a Priority service which is fully trackable. The customer is responsible for any import/customs charges and to liaise with the shipping agent (e.g. FedEx, UPS, DHL) directly to clear their items through their local customs.

5.7 FIGHTLABEL is not responsible for any customs delays. FIGHTLABEL will provide the customer with the tracking number once the item is shipped and then it is the responsibility of the customer to track and monitor their goods.

6 Prices

6.1 FIGHTLABEL may from time to time have to adjust its prices without prior notification.

6.2 All prices exclude VAT and dispatch charges. VAT will be added (where applicable) to the total order including carriage & packing. VAT does not apply if the goods are being sent outside of the EC. Carriage costs are dependent on the size of your order, the destination and service used.

6.3 The customer is required to provide an invoice address for the individual/company responsible for the payment of the goods, a contact name, email address, phone number and registered invoice address. The customer is also required to provide a shipping address (if different from the invoice address). These details are then input to FIGHTLABEL's Xero invoicing system to generate the invoice.

6.4 FIGHTLABEL require all goods to be paid for by the customer at the time of placing the order or prior to the goods being shipped unless specific credit terms have been agreed, and in which case payment must be made within 30 days of the invoice date.

6.5 In the event that payment is not made FIGHTLABEL have the right to withhold delivery of any further goods.

6.5.1 In this instance FIGHTLABEL will require pre payment on all future orders.

7 Returns

7.1 Custom outfit orders cannot be returned for refund/exchange or credit.

7.2 All Goods ordered via the e-commerce online store may be returned for exchange if they are found to be faulty, within 5 days of receipt of the goods. If goods are returned because the wrong size has been ordered, postage will be charge for the return item. Hand wraps cannot be exchanged.

7.3 Should FIGHTLABEL deliver goods incorrectly then FIGHTLABEL will reimburse the return postage cost at the equivalent of Royal Mail’s 1st Class Letter Service at the prevailing rate. FIGHTLABEL will re-deliver the replacement goods Post free. All returns must be authorised by FIGHTLABEL before any goods are returned.

7.4 Goods are returned for exchange at the customer’s cost.

7.5 Shoes must be returned without Wear Marks and the shoe boxes must not be defaced. Any shoes returned with Wear Marks or defaced boxes will not be accepted for exchange or credit by FIGHTLABEL.

7.6 Any claim based on a defect in quality or condition of goods supplied or failure to correspond with specifications must be notified to FIGHTLABEL within 21 days of receipt of goods. In the event that the fault is accepted FIGHTLABEL will replace the goods free of charge subject to availability.

7.7 It is advisable for “Proof of Posting” to be obtained.

7.8 General Return Conditions

In order for a return to be accepted, it must meet the following conditions:

7.8.1 The product must be unused and unworn.

7.8.2 The product must be in its original state and packaging.

7.8.3 Goods must have the original tags attached.

7.8.4 Accessories must have all parts of the original packaging.

7.8.5 Footwear must be in the original shoe box.

7.9 Below products are excluded from returns:

7.9.1 Customised and personalised products.

7.9.2 Hand Wraps, except in case of manufacturing defects

8 Dealing with Goods

8.1 If the customer is reselling goods such as shoes, FIGHTLABEL would like that the recommended retail prices as given on the current FIGHTLABEL Retail price List are used.

8.2 The customer will ensure that any goods supplied by FIGHTLABEL are not copied or duplicated in any way whatsoever.

8.3 The customer shall not employ a third party to onward sell FIGHTLABEL goods purporting to be an employee or agent of FIGHTLABEL without the authorisation of FIGHTLABEL.

9 Warranties & Liabilities

9.1 FIGHTLABEL warrants that the goods sold will correspond with their description on the current FIGHTLABEL website and/or as per the final approved design for custom outfit orders.

9.2 FIGHTLABEL shall be under no liability in respect to any defect arising from fair wear & tear, customer negligence, wilful damage, abnormal working conditions, failure to follow FIGHTLABEL’s instructions (written or oral). Misuse or alteration/repair of the goods without FIGHTLABEL’s approval.

9.3 FIGHTLABEL shall be under no liability as to the quality of the goods beyond the occasion of their first use.

9.4 FIGHTLABEL’s warranty is limited in respect of variations in colour and colour co-ordination, as the base cloth or accessory does not dye identically well during the manufacturing process.

9.5 Any natural imperfections on genuine leathers are to be expected and accepted by the customer. Imperfections on the fabrics used do not qualify as defective.

9.6 FIGHTLABEL do not guarantee their products to the fitness for the purpose intended by the customer. It is the customers’ responsibility to ensure that the goods are suitable for their own purpose.

9.7 The customer approves the final design prior to making any custom orders, therefore FIGHTLABEL cannot guarantee the possibility of any changes the customer wishes after the final design has been approved. Any changes are at the discretion of FIGHTLABEL.

9.8 The customers statutory rights are not affected by these terms & conditions.

10 General

10.1 All correspondence/notices shall be addressed to either parties registered office or principal address that we have on record at the time.

10.2 No waiver by FIGHTLABEL of any breach of the contract by the customer shall be considered as a waiver of any subsequent breach of the same or any other provision.

10.3 This contract shall be enforceable by the laws of England and will be settled as such in the courts of England.

11 Rights

11.1 By purchasing goods from FIGHTLABEL, you are consenting FIGHTLABEL to use any image; either purchased from photographers or taken internally; of our work on the client, during manufacture and during use in action during fights/photoshoots. FIGHTLABEL reserves the right to be recognised for producing work, regardless of other sponsorship deals any client may have in place. FIGHTLABEL reserves the right to publicise work produced for any client as it is our original design and our work.

11.2 FIGHTLABEL will apply a branded logo of FIGHTLABEL's choice on the external of all garments designed and made by FIGHT LABEL. If you wish for us not to apply such a logo, there will be an additional charge per garment at our discretion for the omission of our branding and recognition of our services. If the FIGHTLABEL logo is chosen to be omitted; FIGHTLABEL still reserves the right to publicise our work.

11.3 Conflict of interest; FIGHTLABEL does not have any conflict of interest with any other sports related brands unless their sole nature of business is design and manufacture of custom fight shorts, robes and jackets. Any sponsorship deals a client may have in place with other brands are not in any way related to or affiliated with FIGHTLABEL and their responsibility to produce goods.

11.4 Regardless of sponsorship logos visible on any products produced by FIGHTLABEL; the product remains a FIGHTLABEL product and is not the work of any other brand.

ACKNOWLEDGEMENT by receiving these terms & conditions it is implied that the customer agrees and abides by them.

12 Method of Payment

12.1 Cash in our showroom, we do not accept cash via post.

12.2 Credit Card/Debit Cards over the phone.

12.3 MasterCard/VISA/Amex/Switch/Solo (Western Union/Venmo/Diners are not accepted)

12.4 PayPal is accepted; however there is an additional % charge for processing PayPal payments

When sending payments from overseas, ALL CHARGES must be paid by yourself so that FIGHTLABEL receive the full funds required.

Please send full details with your payments, and please make sure you send us details of what your payment is for, e.g Name or Invoice Number reference.
